Babson Bros. of Chicago has won an out of court settlement (for an undisclosed amount of money) from Coca-Cola Bottling Co. for using the name "SURGE" for their new high-citrus soft drink that they will showcase during the Super Bowl Game tomorrow [Sunday, January 26]. The Surge name has been a trademark of Babson Bros. since 1925.
